1. Acceptance of these Terms
RajinKerja ("the Service") is an internal staff attendance system operated at rajinkerja.com by the employing organisation ("the Operator"). By logging in or using the Service you agree to be bound by these Terms of Use. If you do not agree, do not use the Service.
2. Authorised use only
Access is limited to accounts created by the Operator's administrators. You must keep your credentials confidential, must not share your account, and must not attempt to punch in or out on behalf of another person, submit photographs of another person, or otherwise circumvent face or location verification. Any such act may constitute misconduct and an offence under applicable law, and will be recorded in the audit log.
3. Accuracy of records
Attendance records are created using the server's clock, server-side face verification and the location reported by your device. All punches are subject to supervisor review. The Operator's certified records are the authoritative record of attendance.
4. Personal data
Use of the Service involves the processing of personal data, including biometric data, as described in the Privacy Policy and the PDPA Biometric Consent Notice, in accordance with the Personal Data Protection Act 2010 of Malaysia.
5. Availability and changes
The Service is provided on an "as is" and "as available" basis. RajinKerja and the Operator do not warrant uninterrupted or error-free operation and may modify, suspend or discontinue any part of the Service at any time. Where the Service is unavailable, attendance shall be recorded by the alternative means directed by the Operator.
6. Disclaimer of warranties
To the maximum extent permitted by Malaysian law, RajinKerja disclaims all warranties, express or implied, including fitness for a particular purpose, merchantability and non-infringement. Face verification is a statistical measure and may produce false rejections or false acceptances; every punch is therefore preserved and subject to human review.
7. Limitation of liability
To the maximum extent permitted by law, RajinKerja, its operator, licensors and contributors shall not be liable for any indirect, incidental, special, consequential or exemplary damages, or for loss of profits, data, wages, employment benefits or goodwill, arising out of or in connection with the Service, even if advised of the possibility of such damages. In any event, the aggregate liability of RajinKerja arising out of the Service shall not exceed one hundred Malaysian Ringgit (RM100).
8. Indemnity
You agree to indemnify, defend and hold harmless RajinKerja, its operator, officers, employees and agents from and against all claims, liabilities, damages, losses, costs and expenses (including reasonable legal fees) arising out of or related to (a) your misuse of the Service, (b) your violation of these Terms, or (c) your infringement of any law or the rights of any third party in connection with the Service.
9. Governing law
These Terms are governed by and construed in accordance with the laws of Malaysia. The courts of Malaysia shall have exclusive jurisdiction over any dispute arising out of or in connection with the Service.
